I. Description of Service

1.Dinesh Academy (the software training academy) shall provide educational service network and training services to the registered applicant, which shall include access to classes, instructional materials, and support services. The services offered shall be as described on the academy’s website or in any brochures or other materials provided by the academy.

The academy reserves the right to modify or discontinue any aspect of the services provided, including classes, instructors, materials, or support services, at any time and without notice. The academy shall not be liable to the registered applicant or any third party for any such modification or discontinuation.

2.The registered applicant or Candidate or student or user (hereinafter referred to as STUDENT) shall be responsible for providing accurate and complete information when registering for courses or programs. The academy reserves the right to deny access to its services or to any course or program based on the student's qualifications or suitability for the course or program. The student shall have access to the academy’s services for the duration of their enrolment in a course or program. Upon completion of a course or program, the student's access to the academy's services may be limited or discontinued, unless otherwise specified in writing. The academy shall use reasonable efforts to provide quality services to the student, but makes no warranties or guarantees as to the quality or effectiveness of the services provided. The academy shall not be liable to the student or any third party for any direct or indirect damages or losses resulting from the student's use of the services provided.

3. The academy may use third-party vendors or service providers to assist in providing its services, including but not limited to hosting, maintenance, and technical support. The student agrees to comply with any terms or conditions imposed by such third-party vendors or service providers. The academy may monitor and track the student's use of its services, including but not limited to the student's progress in a course or program, use of instructional materials, and access to support services. Such monitoring and tracking may be used to improve the quality of the academy's services or for other legitimate purposes. The student shall be responsible for maintaining the security and confidentiality of their account information, including but not limited to login credentials and personal information. The academy shall not be liable for any unauthorized access or use of the student's account or personal information.

4.The academy may use the student's personal information for purposes of providing its services, including but not limited to communicating with the student, processing payments, and providing support services. The academy shall comply with all applicable privacy laws and regulations in its use of the student's personal information. The student shall comply with all applicable laws and regulations in their use of the academy's services, including but not limited to copyright and intellectual property laws. The student shall not use the information encrypted in the website for any commercial use and should not use academy's services for any illegal or unauthorized purposes. The academy may terminate the student's access to its services at any time and for any reason, including but not limited to the student's breach of these terms and conditions. The academy shall not be liable to the student or any third party for any damages or losses resulting from such termination

II. Your Registration Obligations

1. As a user of our software training academy, you agree to provide accurate and complete information during the registration process. You are responsible for keeping your account information up-to-date and for maintaining the security of your login credentials. You must not share your login information with any third party or use the account of another person without their permission. By registering for our services, you agree to receive communication from us, including promotional messages and important updates related to your account and the services provided.

2.You acknowledge that providing false or misleading information during registration may result in the termination of your account and may also subject you to legal action. Our academy reserves the right to refuse service, terminate accounts, or remove or edit content at our discretion. By registering for our courses and programs, you agree to provide accurate and complete information about yourself as prompted by the registration form. You also agree to update this information as necessary to keep it accurate and complete. It is your responsibility to maintain the confidentiality of your account and password and to restrict access to your computer or mobile device to prevent unauthorized access to your account. You are responsible for all activities that occur under your account or password. If you believe that your account has been compromised or used without your authorization, please notify us immediately. We reserve the right to terminate your account or refuse service at our discretion, including, but not limited to, situations where we believe that your account has been used in violation of these terms and conditions or applicable laws and regulations.

3. Admission to the course does not guarantee the job or 100% placement.

4.To become eligible for job assistance, the students must fulfil all the terms and conditions regarding session attendance and projects.

5.No refund request will be  entertained for the amount paid as course fees by the candidate at any point of time.

III.User Account, Password, and Security

Dinesh Academy informs candidates that they are strictly prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, updating, or sharing any content that:

  • Belongs to another person and over which the User has no rights.
  • Infringes on any patent, trademark, copyright, or other proprietary rights.
  • Violates any applicable laws.
  • Deceives or misleads the recipient about the origin of such messages or is grossly offensive or menacing in nature
  • Impersonates another person.
  • Contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer resource.

Candidates are also prohibited from:

  • Violating or attempting to violate the integrity or security of the Website or any content belongs to Dinesh Academy.
  • Transmitting any information (including job posts, messages, and hyperlinks) on or through the Website that is disruptive or competitive to the Services provided by Dinesh Academy.
  • Intentionally submitting any incomplete, false, or inaccurate information on the Website.
  • Making unsolicited communications to other Users.
  • Using any engine, software, tool, agent, or other device or mechanism to navigate or search the Website.
  • Attempting to decipher, decompile, disassemble, or reverse engineer any part of the Website
  • Copying or duplicating in any manner any of the content or other information available from the Website.
  • Circumventing or disabling any digital rights management, usage rules, or other security features of the Software.

VII. Termination

Dinesh Academy reserves the right to suspend or terminate a student’s access to the Website and the Services with or without notice and to exercise any other remedy available under law, in cases were,

  • Such User breaches any terms and conditions of the Agreement.
  • A third-party reports violation of any of its right because of your use of the Services.
  • Dinesh Academy is unable to verify or authenticate any information provided by a User.
  • Dinesh Academy has reasonable grounds for suspecting any illegal, fraudulent, or abusive activity on part of such User.
  • Dinesh Academy believes in its sole discretion that User’s actions may cause legal liability for such User, other Users or for Dinesh Academy or are contrary to the interests of the Website.

Candidates are also prohibited from:

VIII. Applicable Law and Dispute Settlement

  • You agree that this Agreement and any contractual obligation between Dinesh Academy and User will be governed by the laws of India.
  • Any dispute, claim or controversy arising out of or relating to this Agreement, including the determination of the scope or applicability of this Agreement to arbitrate, or your use of the Website or the Services or information to which it gives access, shall be determined by arbitration in India, before a sole arbitrator appointed by Dinesh Academy. Arbitration shall be conducted in accordance with the Arbitration and Conciliation Act, 1996. All proceedings of such arbitration, including, without limitation, any awards, shall be in the English language. The award shall be final and binding on the parties to the dispute.
  • Subject to the above Clause, the courts at Chennai shall have exclusive jurisdiction over any disputes arising out of or in relation to this Agreement, your use of the Website or the Services or the information to which it gives access.

X. Revision of Terms

  • Dinesh Academy reserves the absolute right to revise these terms without prior notice, other than by posting revised terms on the website.
  • Dinesh Academy reserves the right to postpone or cancel an event due to insufficient enrolments, instructor emergency, or natural disasters (like floods, earthquakes, political instability, etc.)

XI. Internship

Emergency Extensions: 
Students facing personal emergencies can request a break of up to three (3) months from live sessions. Dinesh academy will extend live sessions access for the same period. However, students using EMI payments (Loan/credit card) must continue their EMI payments. 

Upon the candidate's successful placement in an internship, Dinesh Academy expressly disclaims any responsibility or liability for the candidate's performance during the internship period or thereafter. The candidate shall assume full responsibility for their conduct, performance, and continued engagement with the organisations where they are placed. Any issues arising during or after the internship, including but not limited to performance-related concerns, will be the sole responsibility of the candidate and the host organisations, and Dinesh Academy shall not be liable for any such matters. 

XII. Limitation of Liability

In no event, including but not limited to negligence, shall Dinesh Academy, or any of its directors, partners, officers, employees, agents or content or service providers (collectively, the “Protected Entities”) be liable for any direct, indirect, special, incidental, consequential, exemplary or punitive damages arising from, or directly or indirectly related to, the use of, or the inability to use, the Website or the content, materials and functions related thereto, the Services, User’s provision of information via the Website, lost business or lost End-Users, even if such Protected Entity has been advised of the possibility of such damages. In no event shall the Protected Entities be liable for: 

  • Provision of or failure to provide all or any service by Practitioners to End.
  • Users contacted or managed through the Website.
  • any content posted, transmitted, exchanged, or received by or on behalf of any User or other person on or through the Website.
  • any unauthorized access to or alteration of your transmissions or data; or any other matter relating to the Website or the Service.

XIII. Severability

If any provision of the Agreement is held by a court of competent jurisdiction or arbitral tribunal to be unenforceable under applicable law, then such provision shall be excluded from this Agreement and the remainder of the Agreement shall be interpreted as if such provision were so excluded and shall be enforceable in accordance with its terms; provided however that, in such event, the Agreement shall be interpreted so as to give effect, to the greatest extent consistent with and permitted by applicable law, to the meaning and intention of the excluded provision as determined by such court of competent jurisdiction or arbitral tribunal. 

XIII. Severability

No provision of this Agreement shall be deemed to be waived and no breach excused, unless such waiver or consent shall be in writing and signed by Dinesh Academy.
